Bautzen, October 22, 1876
Dear Mr. Leubner!
I have received your valued letter and out of it have learned with regret that your little child has died. The Lord our faithful God shall solace you
about it. That the little Gerhard is lively and well that delights me. The matter of bequest is not yet regulated completely; he is to be receiving
700 Thaler, which are to be preliminarily registered by mortgage on the property of the grandfather and are to be charged with interest of 4½%. The
conclusion was delayed, because the court adjudged your authorization as not sufficient and requested another one. I always thought, that I already
had written that all in detail to you, but it seems this has not fallen into your hands. I need an authorization, which must have the following
wording:
----------
Herewith I commission and grant authorization to master carpenter Gustav Lotze from Bautzen, to act in place of me in all legal matters, in particular
the matters concerning me regarding the regulation of the bequest of Michael Pallmer from Baden, to settle and conclude legal transactions of all kind
for me, in particular to declare himself as me for accessions to estates, to do, not to do, to let do or to apply for everything that is necessary for
a possible determination of the objects of estate or bequest or parts of the same, to requisition, to rent or to sell real estate, therefore to
conclude, to carry out, to legally or notarially accept contracts, to apply for records and cancelations in the cadastral and the mortgage register,
to take up loans and therefore create mortgages, to charge outstanding money with interests for me and to receipt about it, to defer, to recall, to
relinquish and if necessary to prosecute the same, to appear before authorities instead of me, to issue legally binding statements of all kind in
person or in writing for me, to wait for appointments of all kind, to accept summonses and notifications, to engage with and to answer to legal
actions taken against me, to proceed legitimately, to pretend defenses and tergiversations, to compromise, to reach settlements regarding principal
and ancillary points, to renounce liti et cause, to receive for me money and monetary value and to receipt about it legally valid, to agree to
cancelations of mortgages, to apply for, to accept, to return or to consider as taken oaths, to let publicize for himself court decisions and notices
or to presume them as publicized, to comply to the same or as else to appeal admissible remedies against, to renounce the same again, to adduce
evidence or counterevidence, to nominate witnesses, to hear them or to abandon them again, to produce, to accept deeds, to accept as well transcripts
as original documents, to offer an oath of abnegation for them, to apply for, to inhibit garnishment, auction and public sale, to grant and to recall
subsequent authorizations, to act in place of me in sued cross-claim or insolvency lawsuits, to undersign on behalf of me wherever and how often it is
necessary, actually to do and to carry out everything of that, what my right and concern as well as the object’s urgency requires, even if for one or
another activity my personal presence or a very special mandate might be required, but not included in the preceding text. Eventually I promise to
hold everything done by my representative as agreeable and harmless. I also approve supplemental everything of that, what the referred representative
already has done up to now regarding the intended matter for me.
As authentication of that I have issued this general authorization, have undersigned it personally and will legally admit to it as well.

----------
Just today on the Reformation Day I managed to write this letter, there always was a great deal to do. Hence I only have to ask to send back the
authorization together with the required legalization quite soon.
Concerning our local actions and activities, there is not much to tell about it. The expectations of the things that could develop out of the oriental
confusions are paralyzing the business. Ecclesiastically there are dismal prospects. Our so-called regional synod luckily got to a protest against the
irreligious discontinuation of a Dr. Suhr pp, and now everything remains unaffected.
Now there are 5 detached lutheran congregations in Saxony, in Dresden, Frankenberg, Chemnitz, Planitz and Crimmitzschau, in Lusatia precisely nothing
budges, I am curious, if the ignominious course of the synod, hopes were pinned on at first, will arouse the minds however. One only can say: “God
rectify it” The quarrel between the national church and the free church is most unedifying, and only damages instead of being of any use., however
once it must come to a decision, if the denomination of the church still has any value or not. But I want to close. May it go well with you over there
in the far west and may you be able to go your way in peace at all times. I ask you to send my regards to your dear family and remain your most loyal
Gustav Lotze
Master capenter.

Bautzen, den 22 Oktbr 1876.
Geehrter Herr Leubner!

Doch ich will schließen.
ergebenster
Gustav Lotze
Zimmermeister.
